Terms and Conditions
1. Introductory provisions
1.1. These terms and conditions govern the legal relations and conditions that arise between the MenStore store (hereinafter referred to as the seller) and customers (hereinafter referred to as the buyer) when selling goods through the website of the online store www.menstore.cz. The rights and obligations arising from them are binding for both the seller and the buyer.
2. Order and binding nature of the purchase contract
2.1. All goods ordered through the online store www.menstore.cz are considered binding. By sending the order, the buyer hereby agrees that he has read the business conditions in detail, with which he fully agrees.
2.2. The condition for concluding an electronic order (using a shopping cart) is to fill in the registration data according to the order form. The buyer hereby fully agrees to the provision of personal data and the content of his order.
2.3. The place of delivery of the goods is the address which the buyer has stated in the electronic order. In the event of a necessary change, it is necessary to immediately inform the seller about the need to change the data before notifying the shipment of the goods to the already mentioned address.
2.4. The seller reserves the right to refuse to process the order if the entered address is clearly questionable. The seller will send information about this rejection to the buyer's e-mail address, or will contact him by phone for verification.
2.5. Ownership of the goods takes effect when the buyer pays for the goods (according to the price list) and takes it into personal ownership.
3. Payment and delivery conditions
3.1. All ordered goods that are in stock are shipped within the next 48 hours. Goods that have the status "on request" will be delivered within 2-3 weeks in the case of stock. In case of a longer delivery time, the buyer is asked in writing to confirm his order.
3.2. Payment options: Payment by credit cards - after completing the order, the customer is automatically redirected to the website of the payment terminal to make a secure payment for goods. Upon receipt of the confirmation from the bank / payment terminal, the goods are shipped immediately. Transfer to account - payment for the goods is made by bank transfer. The buyer will receive all the information needed to issue a bank order in the order confirmation, which is sent to him immediately by return to the specified e-mail address. This information also includes the amount that needs to be paid.
3.3. Delivery options: Standardly via Czech Post, s.p. - the goods are sent by registered mail.
3.4. If the buyer repeatedly fails to fulfill its obligation to collect and pay for the ordered goods (according to point 2), the seller has the right to suspend the processing of further orders, or to reject the order or request payment in advance.
4. Protection of personal data
4.1. The Seller hereby undertakes that all personal data provided in any form through www.menstore.cz are confidential and will not be passed on to any other entity. It serves only for the communication between the buyer and the seller.
4.2. By filling out the order form within the online store www.menstore.cz, the buyer gives the seller full consent to the collection and archiving of personal data about the buyer and his purchases during his purchasing activities.
4.3. All information about buyers is stored in accordance with the law of the Czech Republic, especially in accordance with Act No. 101/2000 Coll. on the protection of personal data, as amended. All data obtained from buyers is used exclusively for our internal use and we do not provide it to third parties. The only exception is Česká pošta, s.p., which is passed on to buyers' personal data only for the purpose of delivering the ordered goods.
4.4. We hereby undertake that this data will not be misused or provided in any way to a third party (except for Česká pošta, s.p.). In the case of a written request from the buyer, the data will be deleted from the database at any time.
5. Business conditions
5.1. The goods are subject to prices in CZK and EUR, which are listed on the website of the online store. Postage and packing are charged for the selected goods, which can be changed according to the tariffs of Česká pošta, s.p. for individual EU countries and others. Prices include VAT.
6. Withdrawal from the contract
6.1. The buyer has the right in accordance with the provisions of § 57 paragraph 4 letter c) of Act 4. 40/1964 Coll., Civil Code, as amended, to withdraw from the contract within 14 days of receipt of the goods by the buyer. Withdrawal from the contract must be made by the buyer in a verifiable form.
6.2. If the buyer exercises his right to withdraw from the contract within 14 days, it is absolutely necessary that the goods are unused and undamaged. The following requirements must be observed for a positive withdrawal from the contract: the goods must be in undamaged packaging, must be complete, including labels and other accessories, must be undamaged and must not be used! The goods will be returned to the buyer by registered mail to the seller's address (not cash on delivery). If you meet all the above conditions for the return of goods will be money from and the goods are sent by postal order or transfer to the buyer's account according to the valid order no later than 14 working days after the positive settlement of the complaint. In the event of non-compliance with any of the above conditions, the seller will not accept withdrawal from the consumer contract and the goods will be returned at the expense of the buyer.
7. Complaints
7.1. Complaint means the buyer's notification of defects in the goods, which was made without undue delay after the buyer found such a defect.
7.2. Defective goods means a condition in which the goods have been handed over to the buyer in a quality and design that does not comply with the relevant standard or legislation or purpose for which it is usually used.
7.3. If the delivered goods show obvious defects, or if a claimable defect arises on it, the buyer is entitled to use the Complaint. The length of the warranty period is governed by the applicable provisions (24 months). The complaint will be settled within 30 working days of its notification. If, as a result of a complaint, defective goods are exchanged for goods without defects, the warranty period for new goods runs from the date of receipt of these new goods.
7.4. The buyer submits a complaint in writing - by post - to the seller's contact address. When making a complaint, the buyer must prove that the claimed goods come from the seller. For this purpose, the buyer shall provide the original or a copy of the issued sales document (invoice - tax document) for the claimed goods. The buyer will send at his own expense in the original and undamaged packaging of the goods to the seller's address. Complaints are sent by regular parcel post, cash on delivery will not be accepted. Upon mutual agreement between the seller and the buyer, the complaint can be settled by providing a discount, refund or exchange of goods. In the event that the complaint is not accepted, the seller will send the goods back to the buyer, exclusively at his expense. The seller is not responsible for such defects that arise from careless handling, violent mechanical damage to the goods by the buyer or treatment of the product, which is contrary to the recommended care of the product on the label bearing this information.
8. Final provisions
8.1. All goods shown are for information purposes only. These general terms and conditions enter into force on 1.1.2022.
